Thank you for contacting the Grandparents Rights
Organization.
In response to your questions regarding your rights as a grandparent, each state
governs its own laws with respect to the rights of a grandparent to be able to
have access or visitation with their grandchild. The state that has jurisdiction
over the child is the state where the law will usually be applied. GRO is a
nonprofit organization and is not able to provide legal advice to individuals
regarding their personal cases. We recommend that if you have a question
regarding your own rights to see your grandchild or have a case pending and need
legal help, you should consult with a family law attorney in the jurisdiction
where the case is either pending or where it will be filed. If you do not know
of an experienced attorney practicing family law, we suggest that you either
contact your local Bar Association or the American Academy of Matrimonial
Lawyers at www.aaml.org and search for an attorney in your state and local area.
For cases where you wish to hire or consult with an attorney in the metropolitan
Detroit, Michigan area, you may contact The Law Offices of Richard S. Victor,
PLLC, Of Counsel to Hertz Schram PC.
GRO is pleased to report that most states have either reinstated or amended
their laws to provide some form of rights for grandparents to access the courts
to see their grandchildren if a parent has denied them visitation following the
2000 US Supreme Court case that addressed this issue. We at GRO are attempting
to work with state legislatures in order to continue to improve laws around the
country in order to help reunite children and grandparent who have been
amputated because of family dysfunction, which has prevented grandparents from
being able to see their grandchildren.
